Plenum of the Constitutional Court examined the constitutional case on interpretation of some provisions of Article 179 of the Labor Code

Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev, held a session.

At the court session was examined the constitutional case based on the inquiry submitted by the Prosecutor’s Office of the Republic of Azerbaijan on interpretation of some provisions of Article 179 of the Labor Code.

Having heard the report of Judge S.Salmanova, studied and discussed reports of representatives of interested parties – Head of the Department of Legal Support and Human Rights of the Prosecutor General's Office A. Osmanova and Head of the Economic Legislation Department of the Milli Majlis (Parliament) M.Bazigov, conclusions of specialists – judges of the Court of Appeal of Baku city A.Isgandarov and E.Kazimov, the Supreme Court, the Ministry of Justice, the Office of the Judicial and Legal Council and the Academy of Justice, and opinion of expert – professor of the Department of Labor and Environmental Law, Faculty of Law, Baku State University, Doctor of Law M.Aliyev the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision.

The decision states that taking into account the need to regulate labor relations based on a proportional and reasonable balance of the rights and interests of the subjects in the Labor Code of the Republic of Azerbaijan and the legislation defining the rules and conditions of service in prosecutor's offices, it should be recommended to the Milli Majlis (Parliament) of the Republic of Azerbaijan to settle the issue of preserving the place of work and average wages during the time when candidates who successfully passed the competition were involved in compulsory training for entering the service of the Prosecutor's Office of the Republic of Azerbaijan for the first time.

The decision comes into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
