Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by
Farhad Abdullayev, held a session.
At the court session was examined the constitutional
case based on the inquiry submitted by the Prosecutor’s
Office of the Republic of Azerbaijan on related interpretation of Article 2.1.3
of the Law of the Republic of Azerbaijan “On State Compulsory Personal
Insurance of Judicial and Law Enforcement Officials” in connection with
Articles 2.4, 20.5 and 20.15 of the Law of the Republic of Azerbaijan “On
Service in Prosecutor's Offices”.
Having heard the report of Judge K.Shafiyev, studied and discussed reports of representatives of interested parties – representative of the Prosecutor General of the Republic of Azerbaijan K.Aliyev and the Head of the Social Legislation Department of the Administratibe Office of the Milli Majlis (Parliament) A.Valiyev, the specialists – Chairman of the Administrative Board of the Supreme Court Kh.Mammadov, the Deputy Minister of Labor and Social Protection A.Kerimov the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision.
The decision states that the provision “except for
employees of military prosecutor's offices” of Article 2.1.3 of the Law of the
Republic of Azerbaijan “On State Compulsory Personal Insurance of Judicial and
Law Enforcement Officials”, also refers to non-military servicemen serving in
military prosecutor's offices.
State compulsory personal insurance of prosecutors of
military prosecutor's offices is regulated by the Law of the Republic of
Azerbaijan “On State Compulsory Personal Insurance of Employees of Courts and
Law Enforcement Bodies”.
In accordance with Articles 1 of the Law on the
Prosecutor's Office and Article 3.1 of the Law on Service in the Prosecutor's
Office, compulsory personal insurance of prosecutors' interns is regulated by
the Law “On State Compulsory Personal Insurance of Employees of Courts and Law
Enforcement Bodies”.
The decision comes
into force from the date of its publication, is final, and may not be
cancelled, changed or officially interpreted by any institution or official.
