On December 4, the Plenum of the Constitutional Court
of the Republic of Azerbaijan, held a public session.
At the court session was examined the request of the President of the Republic of Azerbaijan on
compliance with the Constitution of the Republic of Azerbaijan of the dissolution of the Milli Majlis of the Republic of
Azerbaijan on the basis of Resolution of the Milli Majlis of the Republic of
Azerbaijan of December 2, 2019 “Appealing to the President of the Republic of
Azerbaijan to call early elections to the Milli Majlis of the Republic of
Azerbaijan”.
Having opened the session, Chairman of
Constitutional Court Farhad Abdullayev announced the composition of the Plenary
and informed about the issue put forward for discussion.
Head of the Department of Legislation and
Legal Policy of the Administration of the President of the Republic of
Azerbaijan Gunduz Karimov attended the session as a representative of the party
submitted inquiry, and the chairman of the committee of Milli Majlis on legal
policy and state building Ali Huseynli, Chief of Staff of Milli Majlis Safa
Mirzayev and Associate Professor of Constitutional Law of the Faculty of Law of
Baku State University, Ph.D. in Law Nasib Shukurov represented the responding
party.
Following the speeches, the members of
Plenum of Constitutional Court moved to the advisory room, to decide on the
agenda.
After the counsel the Chairman of the
Constitutional Court Farhad Abdullayev read out the decision of the plenary
session of the Constitutional Court of the Republic of Azerbaijan.
The decision states that the “Resolution
of the Milli Majlis of the Republic of Azerbaijan of December 2, 2019, “Appealing
to the President of the Republic of Azerbaijan to call early elections to the
Milli Majlis of the Republic of Azerbaijan” shall be considered to be in conformity
with part I of Article 981 of the Constitution of the Republic
of Azerbaijan.”
The dissolution, by the President of the
Republic of Azerbaijan, of the Milli Majlis of the Republic of Azerbaijan based
on Resolution of the Milli Majlis of the Republic of Azerbaijan of December 2,
2019, “Appealing to the President of the Republic of Azerbaijan to call early
elections to the Milli Majlis of the Republic of Azerbaijan” shall be
considered to be in conformity with part I of Article 981 of
the Constitution of the Republic of Azerbaijan.”
According to the decision, until the
beginning of the activity of the next convocation of the Milli Majlis of the
Republic of Azerbaijan, the parliament – in its current composition – shall retain
powers vested in it in accordance with Articles 111 and 112 and paragraphs 16
and 17 of part I of Article 95 of the Constitution of the Republic of
Azerbaijan, as well as fulfill its representative functions in international
organizations.
The decision comes into force from the date of its
publication, is final, and may not be cancelled, changed or officially interpreted
by any institution or official.
The plenary session of Constitution Court was then announced closed.
