The Plenum of the
Constitutional Court of the Republic of Azerbaijan, chaired by Mr. Farhad
Abdullayev, held its regular session in the procedure of special proceeding.
The constitutional
case was submitted by the Nasimi District Court of Baku city on interpretation of
Article 746 of the Civil Code of the Republic of Azerbaijan in relation with
the possibility of applying of consumer credits to this article.
Having heard the report of Judge Kamran Shafiyev, the reports of the
legal representatives of the subjects interested in special constitutional
proceedings, conclusions of expert, examined the materials of the case the
Plenum of Constitutional Court of the Republic of Azerbaijan
adopted decision.
The decision states that Article 422 of the Civil Code of the Republic of Azerbaijan covers consumer credits. In accordance with the requirements of this Article and the depictive-reasoning part of this Decision, the bank (creditor) may refuse to issue a loan if the debtor 's property becomes bad enough, which may jeopardize the repayment of the debt.
The decision come into force from the date of its publication, is final,
and may not be cancelled, changed or officially interpreted by any institution
or official.
