On April 9, in the Constitutional Court was held a
meeting in connection with the Decree of the President of the Republic of
Azerbaijan "On Deepening Reforms in the Judicial-Legal System" dated
April 3, 2019.
Having opened a meeting, Chairman Farhad Abdullayev
noted that the Presidential Decree is an important legal basis for the
beginning of a new stage in the development of the judicial system.
The Decree of the President of the Republic of
Azerbaijan unanimously adheres to the principles of justice, enshrined in the
Constitution and laws of the country, to increase access to court, to increase
transparency in judicial activity, i21mproving the efficiency of judicial
proceedings, ensuring full and timely implementation of court decisions, as
well as eliminating red tape and other negative phenomena.
It was noted that in the Decree of the Head of State it
is indicated that the principles of justice, impartiality, transparency,
equality of everyone before the law and the court and other principles of
justice enshrined in the Constitution and laws of the Republic of Azerbaijan must
be respected in judicial activities.
The Decree also provides that in order to increase the
credibility of justice, it is necessary to publish court decisions
electronically, distribute cases electronically, ensure the inadmissibility of
non-judicial relations, prevent interference in the activities of the courts,
transparency of judicial proceedings, improvement of the forensic examination process,
application of the institution of mediation, as well as regularly analyze the
practice of protecting of state prosecution and filing protests in the courts
and improving the quality of these activities.
The Decree provided recommendations and instructions
to a number of state bodies for the establishment of specialized courts, with a
view to facilitating the possibility of bringing entrepreneurs to court, as
well as the importance of forming a unified judicial practice, continuation of cases
on humanize the policy of punishment and decriminalization of crimes and
strengthening the social protection of judges and court officials.
It was also noted that the Decree focused on improving
and simplifying judicial proceedings, improving the supporting of courts and
their infrastructure, expanding the use of the Electronic Court informational
system, and increasing the number of judges.
Having appeal to history, the chairman noted that
legal reforms in our country began with the adoption of the first Constitution
of the independent Azerbaijan State in 1995, which resulted from the direct
leadership and hard work of the great leader Heydar Aliyev. The adoption of the
Constitution was an important step in the formation of statehood that meets the
requirements of building a civil society and creating a solid foundation in the
political and legal system.
During the meeting, the Chairman noted that the
positive changes in the development of justice in recent years had been
achieved through the implementation of comprehensive measures in this area; in
general, in the area of modernization of the judicial system, specific policy
documents were adopted, the infrastructure of the courts was updated and the
material and technical base was strengthened, and important steps were taken to
form a new generation of lawyers.
Chairman also noted that the official website of the
Constitutional Court will be updated, will meet all modern requirements and
will provide even more opportunities for prompt reception and examination of
complaints and applications of citizens.
Judges of the Constitutional Court, Isa Najafov and
Sudaba Hasanova, spoke about some shortcomings in the judicial system.
At the end of the
meeting, the Chairman gave relevant instructions to the Office of the Court
regarding the activities of Constitutional Court.
