The Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev, held the special constitutional public court proceedings.

The constitutional case, submitted by the Khatai District Court of Baku City based on the application over the interpretation of Article 528.1 and its relation to Articles 9.2 and 35 of the Code on Administrative Offences of the Republic of Azerbaijan, was considered at the court session.

Having heard the report of Judge Jeyhun Garajayev, the statements of representatives of interested subjects and specialists, the expert’s opinion, having investigated and considered materials of the case, Plenum of the Constitutional Court adopted a decision.

According to the decision, within the meaning of Articles 9.2, 12 and 35 of the Code on Administrative Offences of the Republic of Azerbaijan, the person, who after the prosecution for an administrative offence under the Article 528.1 of the Code on Administrative Offences of the Republic of Azerbaijan did not executed the court’s and other authorities’ decision (with the exception of malicious non-compliance), may incur administrative liability again. 

This decision of the Constitutional Court comes into force from the date of its publication, is final and cannot be cancelled, changed or officially interpreted by anybody or institution.
