The Plenum of the Constitutional Court of the Republic of Azerbaijan held a regular session

The Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev, held its regular session via the procedure of special proceeding. 

At the session, upon the request of Court of Appeal of Sheki city, Constitutional Court examined constitutional case on interpretation of some provisions of Article 83.4 of the Criminal Code of the Republic of Azerbaijan. 

Having heard the report of Judge I.Najafov, the reports of representatives of the interested parties, conclusions of expert, examined the materials of the case, the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision. 

The decision states that according to Article 83.4 of the Criminal Code of the Republic of Azerbaijan if the convicted person has been early released from serving his/her sentence on the basis of the amnesty act, the term of criminal conviction is calculated from the day of release from serving the sentence, i.e. from the date of entry into force of the decision of the authorized body on the application of the amnesty act to a particular person. 

The decision comes into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
