The Plenum of the Constitutional Court of the Republic
of Azerbaijan, chaired by Farhad Abdullayev, held its regular session via the
procedure of special proceeding.
At session was examined the constitutional case,
submitted by Public Prosecutor’s Office of the Republic of Azerbaijan, on the interpretation
of the term "day" provided in Article 333 of the Criminal Code of the
Republic of Azerbaijan
Having heard the report of Judge I.Najafov, the
reports of the subjects interested in special constitutional proceedings,
conclusions of expert, examined the materials of the case, the Plenum of
Constitutional Court of the Republic of Azerbaijan adopted decision.
The decision states that the definition of “day” as
provided for in Article 333 of the Criminal Code of the Republic of Azerbaijan
sets to include 24-hour period. The periods specified in this article shall be
considered from the moment when a soldier on call-up in military service leaves
his military unit without permission or without good reason does not arrive at
the duty station in a timely manner, taking into account that one day is 24
hours.
The decision comes
into force from the date of its publication, is final, and may not be
cancelled, changed or officially interpreted by any institution or official.
