The Plenum of the
Constitutional Court of the Republic of Azerbaijan, chaired by Farhad
Abdullayev, held a regular session in the procedure of special proceeding.
The constitutional
case was submitted by the Court of Appeal of Baku city with respect to interpretation of Article
2.5 of the Civil Code of the Republic of Azerbaijan in relation with
administrative procedure legislation of the Republic of Azerbaijan.
Having heard the report of Judge R.Ismaylov, the reports of the legal representatives of the subjects interested in special constitutional proceedings, conclusions of expert, examined the materials of the case the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision.
The decision states that in the meaning of Article 2.5 of the Civil Code of the Republic of Azerbaijan the provisions of this Code do not apply to the relations arising from the payment of compulsory state social insurance payments, unless otherwise provided by the legislation.
The decision come into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
