2011-06-06 Participation at the XV Congress of European Constitutional Courts

The XV Congress of the Conference of European Constitutional Courts was held on 22-28 May 2011 in the Romanian city Bucharest. At the Congress of the discussion revolved around of 3 main themes. As a result of discussions of the topic “Relations between the Constitutional Court, Parliament and the Government” was concluded that: 

  • political power in the countries should cooperate;
  • powers of Constitutional Courts should not be restricted;
  • depending on the different models of the Constitutional Courts should carry out their powers of constitutional review function;
  • powers of Constitutional Courts may be limited only in the institutional use.

 

As a result of the discussion of the topic “Permissions basic legal (organic) dispute by the Constitutional Court” was concluded that:  

  • the natural collision between the branches of power should be considered as a kind of organic collisions;
  • one of the most contentious issues in practice of Constitutional Courts – the degree of intervention of the Constitutional Courts in the organic collisions;
  • functions of Constitutional Courts may be classified procedurally;
  • the Constitutional Court should not act as a political actor;
  • Association of Constitutional Courts should serve to the general corporate business.

 

As a result of the discussion of topic “Implementing the decisions of the Constitutional Court”: 

  • decisions of the Constitutional Court should be implemented unconditionally;
  • the legal validity of the Constitutional Court should be determined with respect of consolidation;
  • justification of the narrative of decisions of the Constitutional Courts is one of important aspects;
  • Constitutional Courts of the European countries should closely cooperate with the Strasbourg Court, etc.

 

At the XV Congress of the Conference of European Constitutional Courts in the delegation of the Constitutional Court of Azerbaijan Republic took part board member of the Confederation of Azerbaijan Lawyers Judge of the Constitutional Court Jeyhun Garajayev.
