The Plenum of the Constitutional Court of the Republic of Azerbaijan held a regular session

The Plenum of the Constitutional Court of the Republic of Azerbaijan, chaired by Farhad Abdullayev, held its regular session via the written procedure of special constitutional proceedings.

At the court session was examined the constitutional case based on the request submitted by the Geychay District Court on interpretation of Article 9.8 of the Law of the Republic of Azerbaijan "On Management of Municipal Lands" in terms of Articles 13 and 29 of the Constitution of the Republic of Azerbaijan and Article 152 of the Civil Code of the Republic of Azerbaijan.

Having heard the report of Judge S. Hasanova, studied and discussed written reports of representatives of interested parties - the Economic and Social Legislation Department of Milli Majlis, the Supreme Court and the Centre for Work with Municipalities of Ministry of Justice, the Plenum of Constitutional Court of the Republic of Azerbaijan adopted decision.

Decision states that the provision of Article 9.8 of the Law of the Republic of Azerbaijan "On Management of Municipal Lands", restricting the alienation of land, meet the requirements provided for in para VI of Article 29 of the Constitution of the Republic of Azerbaijan and para V of Article 152 of the Civil Code of the Republic of Azerbaijan and does not violate the rights of the owner.

The decision comes into force from the date of its publication, is final, and may not be cancelled, changed or officially interpreted by any institution or official.
